Terms of Service for Florytics

1. Acceptance of Terms

By downloading, installing, or using Florytics ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

Florytics is a mobile application designed to help users manage and care for their plants. The App provides features including but not limited to:

• Plant tracking and organization by rooms
• Watering and fertilizing reminders
• Care history tracking and calendar
• Plant care statistics, analytics, and achievements
• Plant database with nearly 100 houseplants and care instructions
• Photo tracking for plant growth
• Optional premium subscription with additional features

3. User Accounts

Florytics does not require user accounts. All data is stored locally on your device. You are responsible for:

• Maintaining the security of your device
• Backing up your data, for example with the in-app Backup & Restore or your device's backup
• All activities that occur on your device

4. License and Use

4.1 License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use Florytics for personal, non-commercial purposes in accordance with these Terms.

4.2 Restrictions

You agree not to:

• Modify, reverse engineer, decompile, or disassemble the App
• Remove any copyright, trademark, or other proprietary notices
• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to any portion of the App
• Use the App in any way that could damage, disable, or impair the App
• Sell, rent, lease, or sublicense the App

5. User Content

5.1 Your Content

You retain all rights to the content you create within the App, including plant names, photos, and notes. Since all data is stored locally on your device, we do not have access to, store, or claim any rights to your content.

5.2 Responsibility

You are solely responsible for the content you create and store in the App. You agree not to create or store content that:

• Violates any laws or regulations
• Infringes on intellectual property rights of others
• Contains harmful or malicious code

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• That the App will be uninterrupted, error-free, or secure
• That defects will be corrected
• That the App or servers are free of viruses or harmful components

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Service interruption or data loss
• Harm to your plants or property

Our total liability shall not exceed the amount you paid for the App or subscription in the twelve (12) months preceding the claim.

9. Notifications and Reminders

The App provides local notifications and reminders. You acknowledge that:

• Notifications depend on your device settings and may not always be delivered
• You are ultimately responsible for caring for your plants
• The App is a tool to assist you, not a replacement for your own judgment and care
• We are not liable if notifications fail to deliver or if you miss them

10. Updates and Modifications

10.1 App Updates

We may release updates to improve functionality, fix bugs, or add features. You are encouraged to keep the App updated to the latest version.

10.2 Terms Updates

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date. Continued use of the App after changes constitutes acceptance of the new Terms.

11. Termination

You may stop using the App at any time by uninstalling it from your device. We reserve the right to:

• Discontinue the App at any time
• Modify or remove features
• Terminate or suspend your access if you violate these Terms

12. Subscriptions and In-App Purchases

12.1 Premium Subscription

Florytics offers optional premium subscriptions that unlock additional features such as unlimited plants, advanced analytics, unlimited photos, and full care history.

12.2 Billing

All purchases are processed through the platform's store (Google Play or Apple App Store). By subscribing, you agree to the respective platform's terms of service and payment policies.

12.3 Auto-Renewal

The subscription is billed monthly and renews automatically at the end of each billing period unless you cancel it at least 24 hours before the end of the current period.

12.4 Cancellation

You can cancel your subscription at any time through Google Play Store or Apple App Store settings. Cancellation takes effect at the end of the current billing period. Refunds are subject to the respective platform's refund policy.

12.5 Price Changes

We reserve the right to change subscription prices. You will be notified in advance of any price changes, and changes will apply only after your current billing period ends.

13. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we handle data. By using the App, you agree to our Privacy Policy.

14. Intellectual Property

The App, including its design, features, text, graphics, and code, is owned by us and protected by copyright, trademark, and other intellectual property laws. The Florytics name and logo are our trademarks.

15. Apple App Store Additional Terms

If you downloaded the App from the Apple App Store, the following additional terms apply:

• These Terms are between you and Florytics only, not with Apple Inc.
• Apple has no obligation to provide maintenance or support for the App
• In the event of any failure of the App to conform to applicable warranties, you may notify Apple for a refund of the purchase price (if any); Apple has no other warranty obligation
• Apple is not responsible for any claims relating to the App, including product liability, regulatory compliance, or intellectual property claims
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them
• You must also comply with the Apple Licensed Application End User License Agreement

16. Third-Party Services

The App may contain links to third-party websites or resources. We are not responsible for:

• The availability or accuracy of such resources
• The content, products, or services available from such resources
• Any harm or damages from your use of such resources

17. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where the App developer is located, without regard to conflict of law principles.

19. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through:

• Good faith negotiations between the parties
• If negotiations fail, through binding arbitration or small claims court

20. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede all prior agreements and understandings.

22. No Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
